Legal analytics are at the heart of innovation in legal tech and are powering business development and competitive intelligence for law firms, litigation support companies, litigation finance firms, and many others in the legal industry. Seeing the growing demand for legal analytics and litigation trends, UniCourt released our easy to use analytics dashboard to improve access to analytics reports and help legal professionals make more informed decisions.

To highlight the top litigators and law firms across the United States, and share more of our legal analytics, we are kicking off the inaugural post of our litigation analytics series. In each of the reports we’ll recognize the top five plaintiff attorneys and law firms and the top five defense attorneys and law firms for a particular case type across all U.S. District Courts. In the event of a tie like this month’s report, we will recognize both attorneys and/or law firms.

For our first report, we are featuring the top attorneys and law firms for all Labor litigation in U.S. District Courts YTD 2019. This report is based on our classification of NOS Codes related to Labor litigation, which is considered distinct from Civil Rights litigation, such as Employment Discrimination and Employment Disability Discrimination.

Top Plaintiff Attorney Analytics*

This month’s top plaintiff attorney and leader in litigation for Labor cases YTD 2019 is Michael Antonio Faillace.

Mr. Faillace is almost exclusively focused on Labor litigation and “his goal is to represent those in need.” Mr. Faillace “has [also] represented thousands of clients and won over half a million dollars in trials in both the Southern and Eastern District of New York.” He earned his J.D. from Harvard Law School, has an L.L.M. from New York University School of Law, and also has his M.P.A. from John F. Kennedy School of Government. He is also admitted to practice in New York and in the Southern District of New York and the Eastern District of New York.

In addition to being a prolific litigator, Mr. Faillace “is fluent in Spanish, German, French and Italian.” Before opening up his own practice, Mr. Faillace worked as an in-house Employment Counsel with IBM for seventeen years. He has also been an employment discrimination Adjunct Professor at Fordham University School of Law since 1992 and has also been an Adjunct Professor at Seton Hall University Law School.

This month we have a tie between Michael Faillace & Associates, P.C. and Morgan & Morgan, PA for top plaintiff law firm for all Labor cases YTD 2019.

For one of the most prolific plaintiff Labor litigation firms, Mr. Faillance’s firm is a small but formidable operation based out of New York with two Senior Litigation Associates in Jesse Barton and Joshua Androphy. Michael Faillace & Associates, P.C. holds itself out as “a boutique employment law firm that assists both employers and employees in resolving all types of employment law matters.” They handle several types of labor and employment matters, including employment discrimination, Fair Labor Standards Act (FLSA), Americans with Disabilities Act (ADA), Family Medical Leave Act (FMLA), and workplace privacy.

Contrasted to Michael Faillace & Associates, P.C.’s boutique operation, Morgan & Morgan, PA is a nationwide firm with 26 offices in Florida, and 15 other offices across over a dozen states: Alabama, Arkansas, California, Georgia, Indiana, Kentucky, Louisiana, Massachusetts, Mississippi, New York, Pennsylvania, South Carolina, Tennessee, and West Virginia.

Attorney John Morgan founded Morgan & Morgan, PA in 1988 with the firm’s first office in Orlando, Florida, with “just three attorneys, two paralegals and a receptionist.” Today the firm has offices across the U.S. and more than 500 attorneys servicing a wide array of practice areas and a special focus nationwide mass tort litigation. Morgan & Morgan has also made a name for itself by encouraging its attorneys “to take their cases to trial.”

Veronica Thea von Grabow is this month’s top defense attorney for all Labor cases YTD 2019.

Ms. von Grabow is a Principal in the Denver, Colorado office of Jackson Lewis with a practice exclusively focused on management-side labor and employment matters. She “has extensive litigation experience… including wage and hour class actions, discrimination, harassment, and wrongful termination, and systemic discrimination.” She received her J.D. from Loyola Law School and is admitted to practice in California, Colorado, and Montana.

In addition to handling labor litigation, Ms. von Grabow “regularly counsels clients regarding employment matters, such as investigations, termination and disciplinary actions, compliance audits, and policy development.” She also assists corporate clients with conducting “training on prevention of harassment and discrimination in the workplace, and compliance with leave laws.”

This month’s top defense firm for all Labor cases YTD 2019 is Jackson Lewis.

Jackson Lewis is a nationwide law firm that has been “focused on labor and employment law since 1958.” Jackson Lewis has 950+ attorneys located across the U.S. with 61 offices across 37 states and Puerto Rico.

The firm also highlights that it is a founding member of L&E Global, “a global alliance of premier employer’s counsel firms providing specialized, business-focused advice on employment law matters.” Jackson Lewis also provides added background that “L&E Global member firms have more than 1,500 legal professionals across six continents, advising clients on both global and local matters.”

In addition to Jackson Lewis, some other notable firms such as Ogletree Deakins, Littler Mendelson, Seyfarth Shaw, and Morgan Lewis were runners up this month.
